(Terms of Use)

 These Terms & Conditions (“Terms”) govern your access to and use of HuskerGummies.com (the “Site”) and any purchases made through the Site. The Site is operated by Sprinkk LLC (doing business as “Husker Gummies,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1) Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted on the Site. Your continued use of the Site after changes means you accept the updated Terms.

2) Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect and use personal information.

3) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase on the Site. By placing an order, you represent that you are legally able to enter into these Terms.

4) Accounts (If Available)

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend or terminate accounts if we believe they’re being used fraudulently or in violation of these Terms.

5) Orders, Pricing, and Payment

a) Order Acceptance. Your order is an offer to purchase. We may accept, reject, cancel, or limit quantities for any reason (including suspected fraud, inventory issues, shipping limitations, or errors).

 b) Pricing & Errors. Prices and availability can change without notice. If we discover an error (pricing, description, availability), we may correct it and/or cancel the order and refund you. 

 c) Taxes. Applicable sales tax will be added where required.

 d) Payment Processing (Stripe). Payments are processed by Stripe or Stripe-connected methods. We do not store full payment card numbers. Stripe may handle payment authorization, processing, and customer disputes/chargebacks under its terms and processes.

6) Shipping, Delivery, and Risk of Loss

Shipping options and estimated delivery times are shown at checkout and may vary. Title and risk of loss pass to you upon our delivery of the order to the carrier, to the extent permitted by law.

7) Returns, Refunds, and Replacements

Food products are often treated as final sale for safety reasons, except where required by law or where our posted policies state otherwise.

If your order arrives damaged or incorrect, contact us at within 3 days of delivery with your order number and photos of the packaging/product so we can evaluate and help with a replacement or refund as appropriate.

8) Promotions, Discount Codes, and Giveaways

Promotions may be modified, suspended, or canceled at any time. Discount codes may have expiration dates, usage limits, and may not be combined unless explicitly stated.

9) Prohibited Uses

You agree not to misuse the Site. You may not:

introduce viruses, malware, or harmful code,

attempt unauthorized access to the Site or its systems,

interfere with the Site’s operation or security, or

use automated tools to scrape or harvest data without permission.

10) Intellectual Property

All content on the Site—including text, graphics, photos, logos, product names, packaging designs, and trademarks—is owned by or licensed to Sprinkk LLC / Husker Gummies and is protected by intellectual property laws. You may not use or reproduce any Site content without our prior written permission.

11) User Content (Reviews, Photos, Tags)

If you submit content (e.g., a review, photo, video, comment, or social tag), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for marketing and business purposes, unless prohibited by law. You represent you have the rights to submit it.

12) Third-Party Services (Duda Platform + Other Tools)

The Site may be built and hosted using Duda and may rely on third-party services (e.g., payments, shipping tools, analytics, email/SMS tools). Third-party services are provided under their own terms, and we are not responsible for third-party service outages, errors, or performance.

13) Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPRINKK LLC / HUSKER GUMMIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

15) Indemnification

You agree to defend, indemnify, and hold harmless Sprinkk LLC / Husker Gummies and its owners, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or your violation of these Terms.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Unless otherwise required by law, you agree that disputes will be brought in state or federal courts located in Douglas County, Nebraska.
